A 41-year-old man was struck by a car and killed on I-5 in Albany, Oregon, on March 22, 2010, around 9 PM, according to an Oregon State Police press release.

Roger Wolcott Blakely III, 41, was trying to cross the southbound lanes of I-5 from west to east on foot, when he was struck by a car driven by Dana W. Bishop, 60, of Springfield. Blakely was pronounced dead at the scene.

Blakely’s last known address was in Southwest Portland.

None of the occupant’s in Bishop’s car, including his wife and mother-in-law, were injured.

OSP troopers could not locate a car belonging to Blakely, and they are continuing to investigate.

We send our thoughts and prayers to Blakely’s family, and hope they will receive comfort and support from family and friends as they mourn this loss.

If an Oregon pedestrian is hit in a crosswalk, it is generally considered the driver’s fault. However, similar to how there are several complexities in the law, there are exceptions to the potential causes of such an accident. If it was dark and the pedestrian was drunk and wearing dark clothes, the driver can sometimes escape prosecution. Or if a pedestrian darts out unexpectedly into an intersection, the law may take the driver’s side too. But in most cases, the law will consider it to be the driver’s fault, and the pedestrian or the pedestrian’s family will be able to get legal compensation.

All pedestrian accident cases are different, of course, so contact a knowledgeable Portland pedestrian accident lawyer if you have any questions about your personal injury case. We can answer many questions and offer a free consultation.
