Fatal Crash Prompts Safety Investigation | Oregon Truck Accident Lawyers

Names: Marc Moberly, Roman Fabyanchuk

On December 7, 2009, Marc Moberly, 51, of Silverton, Oregon, died in a crash on Marquam Road near Mt. Angel. According to the Woodburn Independent, Moberly’s pickup truck was hit by a semi truck driven by Roman Fabyanchuk, 25, of Washington.

Moberly was taken to Oregon Health & Science University Hospital by Life Flight. He died there later the same day.

Head-on Crash Kills 2, Injures 3 | Oregon Car Accident Attorneys

A 24-year-old Salem woman and teen were killed and 3 others were seriously injured in a head-on crash December 6, 2009, on Highway 223 near Dallas, Oregon, after a driver crossed the center line for unknown reasons.

Rebecca Dunaway, 24, of Salem, died in the crash, which occurred around 8:35 PM. Daymon Wachtler, 18, of Keizer, was critically injured and later died at the hospital.

Cannon Beach Crash Kills 1, Injures 4 | Oregon Car Accident Lawyers

A two-car, head-on crash on Highway 101 near the Arch Cape Tunnel, in Cannon Beach, Oregon, killed Charles E. Nilson, 83, and seriously injured his wife, Carol, 79, and daughter, Debra, 53. A couple, Tom Watson, 64, and his wife, Sydnee, 62, both of Walla Walla, who were in the truck he collided with, was also injured in the accident.

Prineville Rollover Truck Crash Seriously Injures Passenger

Names: Donald Ray Carter

Police say alcohol and speed were factors in an October 10, 2009, single-vehicle rollover crash that threw a passenger, Donald Ray Carter, 24, of Prineville, Oregon, from a truck, seriously injuring him.

A male juvenile from Prineville, Oregon, was driving a 1991 Chevy truck on Mill Creek Road, just north of Hwy. 26E, east of Prineville, around 11:30 PM, when he lost control of the vehicle. The truck slid across both lanes and rolled at least twice, landing about 60 feet away from the road. Carter was thrown from the cab of the truck.

When Crook County Sheriff’s deputies arrived, Carter was behind the truck, complaining of injuries. He was transported by ambulance to Pioneer Memorial Hospital in Prineville, then flown by AirLink helicopter to St. Charles Medical Center – Bend, where he was listed in critical condition. The juvenile driver received minor injuries.

Neither the driver, whose name was not released, nor Carter, was wearing a seatbelt. KTVZ.com reports that, according to authorities, alcohol and speed were apparent factors in the crash. As of October 11, no citations had been issued, and authorities continued to investigate.

Along with the Crook County Sheriff’s Office, the Oregon State Police and Crook County Fire and Rescue responded to the accident.

According to the Centers for Disease Control and Prevention, there are up to 36 deaths and 700 injuries every day in the U.S. due to motor vehicle crashes involving an alcohol-impaired driver. The CDC reports that in 2006, 13,470 people died in alcohol-impaired driving crashes. This comes to almost one-third of all U.S. traffic deaths. And in 2007, more than 1.4 million drivers were arrested for driving under the influence – but this is less than 1% of persons who admit to driving impaired each year. Male drivers and young people are especially likely to be involved.

Appeals Court Rules Implied Consent Is Coercion | Oregon Accident Lawyers

In a September 30, 2009, Oregon Court of Appeals ruling, the court equated implied consent laws with coercion, calling into question the constitutionality of state rules mandating consent to intoxicant testing as a condition for obtaining a license.

Oregon’s implied consent law says anyone licensed to drive is considered to have consented in advance to any future breath, blood, or urine testing, should they ever be arrested for driving under the influence of intoxicants. It also states that if a driver tries to revoke that consent by refusing the tests, this refusal may be used as evidence in court.
