Location: Highway 58 East of Oakridge
Names: Ellis Michael Heyer, Collin Phillip La More, Nicholas John Ries

According to a Portland news station, Oregon State Police released the names of two young men killed in a single-car crash.

Police reports state that at approximately 7am a 1987 BMW driven by Nicholas John Ries, age 21 of Portland, was heading east on Highway 58 about 15 miles east of Oakridge when the vehicle veered off the shoulder and the BMW’s passenger side hit a large tree. Road conditions at the time were said to be foggy with patches of ice.

The two men who died were Collin Phillip LaMore, age 21 of Stockton, California who formerly lived in Tigard, and Ellis Michael Heyer, age 21 of Amherst, Massachusetts. LaMore was the front passenger and Heyer was seated in the rear. Ries was transported to Sacred Heart Medical Center with serious but non-life threatening injuries. All were students at the University of Oregon.

An off-duty fire captain arrived at the scene and assisted until emergency crews arrived. The BMW caught fire about 10 minutes after impact and was extinguished once fire crews arrived.

We are so saddened by the news of this accident, where Mr. LaMore and Mr. Heyer had their lives shortened by this tragic collision. Our thoughts and prayers are with their families as they mourn their loss. We also wish Mr. Ries a complete recovery from this horrific event.

Fatal Oregon Car Crash on Highway 35 Claims Man’s Life

Date: January 21, 2011
Location: Highway 35 South of Parkdale
Names: Robert Steven Cupit, Fred E. Jorgensen

Oregon State Police are still investigating the death of a Parkdale-area man in a fatal traffic crash on Highway 35 north of Bennett Pass.

The Beaver Journal reports that at about 5:55pm Fred E. Jorgensen, age 63 of Husum, Washington, was driving a 2003 Kenworth truck pulling a dump trailer northbound on Highway 35 near milepost 77. Coming around a curve, Jorgensen found himself being approached head-on in his lane of traffic by a 1996 Honda Accord driven southbound by Robert Steven Cupit, age 63 of Parkdale.

Jorgensen attempted to avoid the oncoming car by steering to the left, but the Honda crashed into a wheel axle on the right side of the dump trailer, tearing away the car’s passenger side before stopping.

Jorgensen was using safety restraints and was uninjured. Cupit, who was not using safety restraints, was pronounced dead at the scene.

We are saddened by this tragic accident and extend our sincere and heartfelt condolences to the family and friends of Mr. Cupit. Our thoughts are with them as they mourn his death. We also hope that Mr. Jorgensen will recover fully from this serious accident.

Woman Struck by Two Vehicles in Oregon Pedestrian Accident

Posted by Portland Personal Injury Attorney on Tuesday, January 11, 2011

Date: January 4, 2011
Location: Southeast 82nd Ave at Otty Road, Portland, OR
Names: Chastity Ann Banks, Sarah E. Guenther, Craig H. Dunlap

In updated news releases, Oregon State Police are now reporting that two separate vehicles ran over a woman who was crossing the street in a marked crosswalk recently.

The woman was identified as Chastity Ann Banks, age 27, who was crossing in a crosswalk at Southeast 82nd Avenue at Otty Road at about 3pm on Monday January 3. A 2004 Kia driven by Sarah E. Guenther, age 19 of Happy Valley, was the first vehicle to strike Banks as Guenther was making a left turn from Otty onto 82nd Avenue. A Ford F-150 pickup truck driven by Craig H. Dunlap, age 48 of Happy Valley, was also making a left turn behind Guenther and tried to pass to the right of Guenther, who had stopped because she had already struck Banks. Dunlap also struck and ran over Banks.
Portland news sources reported that eyewitnesses in a nearby vehicle saw Guenther putting on what appeared to be lip balm at the intersection a few seconds before the crash.

Banks was last reported in critical condition at Oregon Health and Science University Hospital for injuries sustained in the Oregon pedestrian accident. Banks, previously of Atlanta, Georgia, lives in the Portland area.

Our thoughts are with Chastity Banks and her family, and we hope that she will have a complete recovery from her injuries.

If a pedestrian is hit in a crosswalk, it is generally considered the driver’s fault. However, just like everything in the law, there are exceptions. If a pedestrian darts out unexpectedly into an intersection, the law may take the driver’s side. But in most cases, the law will consider it to be the driver’s fault, and the pedestrian or the pedestrian’s family will be able to get legal compensation.

In this instance, eyewitnesses stated that they saw Guenther, perhaps, distracted seconds before the crash. And Dunlap hit Banks a second time as he tried to drive past Guenther’s stopped vehicle. All cases are different, of course, so contact a knowledgeable lawyer if you have any questions about your case.
