Oregon Personal Injury Law Questions and Answers

Q: How much time do I have to file a claim if my child is injured?

A: The statute of limitations can be complex in the case of a child's injury. Oregon Revised Statute 12.160 stipulates that the time available to file a claim for such an injury cannot start until age 18. However, that time limit will never extend past 5 years. Unfortunately, the time limit cannot be extended beyond the child's 19th birthday.

As you can tell, cases in which children are injured can grow to be very confusing. If you are in this situation, please contact our office, and we can assist you in finding out the appropriate statute of limitations for your child. If you feel that you can find the answer for yourself, details about ORS 12.160 are available at the Oregon Legislative's website, http://leg.state.or.us/ors/012.html.
