If you were a pedestrian seriously injured in a car or bike accident, call us at 503-222-4411 to talk to one of our personal injury attorneys.
As a pedestrian, you are one of the most vulnerable people on the road. But, because you are the most vulnerable, under Oregon law, you should also be one of the most protected.
In 2007, Oregon introduced what is called "vulnerable user laws" to help protect those who are not protected by the shell of a car. And because there is no protective encasing surrounding pedestrians, they suffer serious injuries and even death. In 2007, 4,654 pedestrians were killed in traffic crashes in the United States, according to the NHTSA, and 70,000 were injured. In Oregon that same year, there were 455 traffic deaths - 48 of those were pedestrians.
Another issue that arises from being a pedestrian is that of a lack of insurance coverage. Even if a pedestrian has a car, that does not mean that insurance comes into play if a person is hit by a car. For most car accidents, a person's PIP, or personal injury protection coverage, will cover medical bills for up to a year or $15,000, whichever comes first. In a pedestrian-car accident, the driver's PIP should pay according to ORS 742.520.
As knowledgeable personal injury attorneys, it is our duty and our goal to help pedestrians who have been seriously injured as a result of a driver's inattention, recklessness, or complete disregard for the law. To do that, we offer a free initial phone consultation. Just call us at 503-222-4411. We also wrote a book that we believe helps everyone understand the personal injury process better. From insurance policies, to how to deal with nagging insurance companies, to getting the proper medical attention, 7 Common Mistakes That Can Wreck Your Oregon Accident Case. It's free for residents of Oregon, or anyone who has been injured in an accident in Oregon. If you live outside Oregon, please order the book on Amazon.com; it costs $16.95.
You may also contact us through our website. Just fill out the form, leave some information about the details of your accident, and we will call you to discuss your case and what legal options you may have to pursue.
We also have a page on our website where you can find information on settling your case without a lawyer. This is usually reserved for smaller cases in which the monetary damage does not exceed $10,000. And in pedestrian accidents, which don't have damage to a vehicle and can often include only minor injuries to the pedestrian, this can be a lot of help.
You can also read our blog about pedestrian accidents. It can contain some useful information and more on the laws as they pertain to pedestrians.
